A few days ago, the Minister of Roads of Ghana told the media that in the next four years, Ghana will build 6,000 kilometers of roads, 120 bridges and 20 overpasses. In order to ensure that contractors guarantee the quality of construction projects, the Ghanaian government has promulgated five-year minimum quality assurance regulations for construction projects to strictly regulate the quality responsibilities of project contractors.
The project quality guarantee fund means that in order to implement the maintenance responsibility of the project during the defect liability period, the construction unit (owner) and the construction company have agreed in the project construction contracting contract to reserve from the payable construction funds to guarantee the construction company During the defect liability period, the funds for repairing defects (that is, the quality of the project construction does not meet the mandatory standards of project construction, design documents, and the agreement of the contract) that have passed the completion (delivery) inspection and acceptance of the project. The project quality guarantee fund is directly detained by the construction unit (owner) from the construction enterprise's engineering measurement appropriation by multiplying the total settlement amount of the project price by the contractual ratio (usually 5%), and generally no interest is calculated. The construction enterprise shall earnestly perform the contractual responsibility within the defect liability period (usually twelve months) after the completion (delivery) of the project has passed the inspection and acceptance. After the defect liability period expires, it shall apply to the construction unit (owner) for return in a timely manner Engineering warranty money. The construction unit (owner) should return the project quality guarantee fund to the construction enterprise in time (if there are defects within the defect liability period, the corresponding defect repair costs will be deducted).
At present, the statutory quality guarantee period for Ghana's road and bridge projects is only 12 months, resulting in widespread damage to many road and bridge projects after the warranty period. The new regulations significantly extend the contractor’s minimum quality assurance responsibility to 5 years, which is expected to significantly increase the quality and cost of the project.
